These Terms of Service ("Terms") govern your use of RoofingSwap (the "Service"), operated by RoofingSwap ("we," "us," "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
RoofingSwap is a marketplace that connects homeowners who request roofing help with licensed roofing contractors ("roofers"). We are not a roofing contractor, we do not perform roofing work, and we are not a party to any agreement a homeowner and a roofer reach. We do not employ, endorse, license, or guarantee any roofer, and we are not responsible for the quality, timing, safety, legality, or outcome of any work performed.
Submitting a request is free. When you submit a request, you consent to be contacted by RoofingSwap and by the roofer who purchases your request, by phone, text, or email, so they can provide an estimate. You are under no obligation to hire any roofer. You are solely responsible for evaluating, selecting, contracting with, and paying any roofer, and for confirming a roofer's license, insurance, and references before hiring.
Fees are described at the point of purchase and are charged through Stripe. Leads are generally final once the homeowner's contact details are revealed. As a courtesy, we may issue a refund or credit for a lead that is invalid under our refund policy, for example a wrong or disconnected phone number, a duplicate, a request outside the roofer's service area, or a homeowner who did not actually request service. Refund requests must be made promptly and are reviewed at our discretion. Subscription fees already charged are non-refundable except where required by law.
You agree not to: misuse homeowner data or share it beyond providing the requested estimate; resell, scrape, or redistribute leads or other content; submit false or fraudulent information; interfere with or attempt to disrupt the Service; or use the Service for any unlawful purpose.
The Service, including its content, branding, and software, is owned by RoofingSwap and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error free, or that any lead, roofer, or homeowner will meet your expectations.
To the fullest extent permitted by law, RoofingSwap will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid to us in the three months before the event giving rise to the claim.
You agree to indemnify and hold harmless RoofingSwap and its officers, employees, and agents from any claims, damages, liabilities, and expenses arising out of your use of the Service, your violation of these Terms, or your interactions or agreements with any homeowner or roofer.
We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or use the Service in a way that could harm us, other users, or third parties. You may stop using the Service at any time.
We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the United States and of the state in which RoofingSwap is established, without regard to its conflict-of-law rules. Any dispute will be resolved in the courts located in that jurisdiction.
